Thiruvananthapuram, July 4 (SocialNews.XYZ) The Kerala government's decision to withdraw and redraft a controversial order granting prosecution sanction in the alleged multi-crore cashew import corruption case has sparked questions over whether entrenched interests within the Secretariat continue to influence key decisions despite a change in political leadership.
Chief Minister V.D. Satheesan is yet to respond to the controversy surrounding the order, which was issued by the Industries Department sanctioning CBI prosecution against former Kerala State Cashew Development Corporation Managing Director K.A. Ratheesh and INTUC president R. Chandrasekharan.
While the sanction itself followed the High Court's direction, it was the extraordinary language in the order that triggered alarm within legal and government circles.
The order reportedly suggested that the government had granted sanction only because it had been compelled by the High Court to do so.
It also carried observations interpreted as questioning the court's role and, unusually, referred to the accused's right to challenge the sanction order.
Legal experts believe such remarks, had they been placed before the High Court, could have exposed the government to serious judicial scrutiny and even contempt proceedings.
The crisis was averted when Advocate General K. Jaju Babu declined to produce the order before the court, instead seeking additional time to clarify its contents.
The government has since begun preparing a revised order for submission when the case comes up again next week.
The episode has fuelled speculation over whether the controversial drafting was merely an extraordinary administrative lapse or part of a more calculated attempt to place the government in an embarrassing legal position.
The fact that such observations found their way into a sensitive government order has raised concerns over the functioning of the bureaucratic machinery handling high-profile corruption cases.
Equally intriguing is another development that has left legal circles puzzled. Before the order was produced in court, its controversial contents surfaced at a press conference addressed by one of the accused.
How a confidential government document under judicial consideration reached the hands of an accused has become a question demanding answers. It has intensified calls for an internal inquiry into possible breaches of official confidentiality and the movement of sensitive files within the Secretariat.
The developments have revived a larger debate over whether elements of the old administrative establishment continue to influence key decisions behind the scenes, irrespective of the political leadership in office.
Whether the controversy stemmed from bureaucratic incompetence or a deliberate attempt to undermine the government's legal position is now the question confronting the administration.
The answer could have implications extending far beyond a single corruption case.
