NGT directs removal of encroachments from Hingonia Dam area in Rajasthan

Jaipur, May 21 (SocialNews.XYZ) The National Green Tribunal (NGT), Central Zone Bench, Bhopal, has issued significant directions for the protection of the Hingonia Dam area in Rajasthan and the removal of unlawful encroachments from the site.

The matter was heard by Justice Sheo Kumar Singh, Judicial Member, and Sudhir Kumar Chaturvedi, Expert Member.

 

During the hearing of Application No. 07/2025 (CZ), titled Kamlesh Roj vs State of Rajasthan & Others, counsel appearing for the State of Rajasthan and the Jaipur Development Authority (JDA) informed the Tribunal that additional action-taken reports had recently been submitted before the Bench.

However, the applicant raised concerns regarding alleged discrepancies between the original total area of Hingonia Dam and the area reflected in the reports submitted by the authorities.

Counsel representing certain respondents submitted that relevant details relating to the dam area had already been provided in the report filed by the concerned Sub-Divisional Magistrate (SDM).

The applicant also pressed Interim Application No. 30/2026 seeking interim relief, along with Interim Application No. 72/2026 concerning the applicability of the Wetland Conservation and Management Rules, 2017.

The Tribunal observed that issues relating to wetlands exceeding 2.25 hectares would be governed by directions issued earlier by the Supreme Court.

The NGT directed the District Collector and the Jaipur Development Authority (JDA) to remove unlawful encroachments from the Hingonia Dam area by following due process of law.

Observing that the Rajasthan Water Resources Department is the custodian of the dam, the Tribunal further directed the Principal Secretary of the department to examine the matter and ensure that the entire dam area remains under the department’s custody, supervision and protection.

The Tribunal also instructed the department to initiate necessary action in case any encroachments are found in the area and submit an affidavit before the next date of hearing detailing the action taken.

Since pleadings in the matter have been completed, the Tribunal listed the case for final hearing on July 2, 2026.

The order is being seen as significant in the context of environmental protection, preservation of water bodies and enforcement against encroachments in ecologically sensitive zones.

The matter has also drawn attention because of the growing concerns over shrinking wetland areas and increasing pressure on natural water resources due to urban expansion and illegal occupation.
