Patna, July 31 (SocialNews.XYZ) Political activity in Bihar intensified on Friday after Bharatiya Janata Party (BJP) MLC Devesh Kumar resigned from his seat in the Bihar Legislative Council, paving the way for Panchayati Raj Minister Deepak Prakash to potentially enter the Upper House.
Devesh Kumar reached the Bihar Legislative Council through the back entrance on Friday evening and submitted his resignation to the Chairman.
Several senior BJP leaders, including State party President Sanjay Saraogi, were present when he tendered his resignation.
Following the resignation, preparations are reportedly underway to nominate Deepak Prakash for the vacant Legislative Council seat.
Deepak Prakash is currently serving as the Panchayati Raj Minister in the Bihar government, but is not a member of either the Legislative Assembly or the Legislative Council.
Under Article 164(4) of the Constitution, a Minister who is not a member of the State Legislature must secure membership of either House within six months of being appointed to the Council of Ministers.
The issue had become politically contentious, with opposition parties repeatedly questioning how Deepak Prakash could continue as a Minister without legislative membership.
The matter had also reached the Supreme Courts, where the state government was asked to respond.
With Devesh Kumar's resignation creating a vacant Legislative Council seat, the ruling NDA appears to have found a route to address the issue.
Deepak Prakash is expected to be fielded for the vacant seat, subject to the formal nomination and election process.
The opposition has said that constitutional requirements must be strictly followed, while the ruling NDA has asserted that all necessary steps would be taken in accordance with the law.
Political observers view Devesh Kumar's resignation as an important development for the Bihar government.
If Deepak Prakash is elected to the Legislative Council, it would resolve the immediate constitutional issue surrounding his Ministerial position and provide him with a formal place in the State Legislature.
An official announcement regarding his candidature is awaited.
