Mumbai, July 18 (SocialNews.XYZ) In a blow to Shiv Sena (Eknath Shinde) corporator Ramesh Mhatre, the Bombay High Court on Saturday cancelled the bail granted to him in a case related to alleged assault on three doctors in a civic hospital in Kalyan earlier this month, directing him to surrender before police on Sunday.
A division bench headed by Acting Chief Justice Ravindra Ghuge took suo motu cognisance of the Magistrate’s order that granted bail to Mhatre and expressed surprise over the relief granted without dealing with the antecedents of the accused and the assault caused on the three doctors.
The bench noted that while granting bail to Mhatre and his four co-accused, the Magistrate had “virtually let go” of Mhatre without directing him to appear in a police station and co-operate with investigators.
The Acting Chief Justice noted that if Mhatre fails to surrender at Dombivli police station by 5 p.m. on Sunday “…the authorities will be at liberty to follow the due procedure for initiating steps for attaching his immovable properties”.
The High Court also appealed to the doctors' association to call off the statewide strike on July 22 against the alleged assault on their colleagues and the bail granted earlier by the Magistrate to Mhatre and his four associates.
After Saturday’s hearing, the division bench posted the matter for the next hearing on July 21.
The alleged assault incident took place on July 6 at Shastri Nagar Hospital, operated by the Kalyan-Dombivli Municipal Corporation in Dombivli.
According to hospital authorities, the dispute began after two doctors, a man and a woman, advised the family of a newborn to shift the infant to another hospital because the Neonatal Intensive Care Unit (NICU) was full. The doctors had recommended the transfer to ensure the baby received appropriate medical care.
The relatives subsequently contacted Shiv Sena corporator Ramesh Mhatre, who arrived at the hospital along with his associates.
A video of the incident showed Mhatre and his supporters arguing with doctors and hospital staff. During the altercation, he allegedly approached a woman doctor from behind and struck her mobile phone, causing it to fall.
He then allegedly assaulted another doctor and other members of the hospital staff. One of the doctors sustained injuries in the incident.
Later, Mhatre denied assaulting the doctors and refused to apologise. Speaking to NDTV, he claimed that he did not attack the woman doctor but merely pushed away her mobile phone as she was not listening to them.
He also asserted that his intervention helped save the lives of a woman and her newborn, adding that he had nothing to regret.
