New Delhi, May 12 (SocialNews.XYZ) The Supreme Court on Tuesday asked CBI to respond on a bail plea of controversial Uttar Pradesh politician D.P. Yadav, convicted in the murder of a lawmaker.
A bench comprising L. Nageswara Rao, S. Abdul Nazeer and Sanjiv Khanna issued notice to the CBI and asked it to respond on the plea by next week.
Yadav is currently lodged in a Dehradun jail serving a life term. He had moved the apex court seeking bail on medical grounds. Yadav was sentenced to life by a CBI court in Dehradun in 2015 for his role in the murder of Mahendra Singh Bhati, an MLA from Ghaziabad's Dadri area, who was shot dead at Dadri at a railway crossing in December 1992.
Advocate Vikram Chaudhary, representing Yadav, contended before the bench that he was earlier granted interim bail to undergo a spinal surgery at the Yashoda Hospital in Ghaziabad. After the surgery, Yadav surrendered as per the apex court order. The counsel submitted that Yadav is facing some post-surgery complications and the prison authorities have also suggested medical consultation at All India Institute of Medical Science (AIIMS).
The top court noted that it would like to see the CBI response on this plea.
The apex court in October 2018 had directed Yadav to surrender and go back to prison to serve the remainder term of his life sentence. The top court after considering the medical report post-surgery directed that Yadav could remain with his family for two weeks. Later, he would have to go back to the jail to serve the remaining sentence.
Yadav moved the apex court after the Uttarakhand High Court had declined to entertain his plea for interim bail to undergo surgery.
His appeal challenging the trial court verdict convicting him is pending before the High Court.
