New Delhi, Feb 2 (IANS) The Delhi High Court on Tuesday, while refusing to quash a notification that fixed upper age for admission to schools for entry level education at four years, exempted three kids and said other aggrieved parents can approach it too.
Justice Manmohan took into the record the submission of Delhi government's counsel that cap will not apply to the three kids who approached the court within time, prior to the last date of the application process.
The court said the December 18, 2015, order, fixing upper age limit, will not apply to the three kids and said other parents who wish to challenge the order can approach the court and it will hear their grievance too.
Advocate Ashok Agarwal, however, objected to the decision saying the order must be applied equally to others who have not approached the court. The court said three parents move the court and relief will be given to them.
By the December 18 notification, the Delhi government fixed the upper age limit for pre-school (nursery), pre-primary (KG) and class one.
One of the pleas was filed by Uday Pratap Singh Kapoor, a child two years and ten months old, through his mother Simran Brar, against the circular which fixed the upper age limit for admission to pre-School at "less than four years as on March 31, 2015".
Advocate Akhil Sachar, counsel for the petitioner, said his client cannot seek admission to a pre-school class in 2017 as he will be four years and one-month-old and requested the court to allow the child to take admission in pre-school for the academic year 2017-18.
