Jaipur, May 19 (SocialNews.XYZ) A court in Ajmer has ordered the registration of a case against Bharatiya Janata Party City President Ramesh Soni for allegedly reposting and sharing an objectionable social media post targeting the Delhi Chief Minister.
The order was issued by the Additional Chief Judicial Magistrate (No. 2), directing the Ganj Police Station to register the case.
The matter arose from a complaint filed by Shreyans Surana, a resident of Foy Sagar Road.
Through his counsel, Advocate Vaibhav Jain, the complainant alleged that an objectionable post targeting the Delhi Chief Minister was originally uploaded from his brother's Facebook account, Piyush Surana.
It was further alleged that Ramesh Soni reposted and shared the same content from his own Facebook account, thereby amplifying its circulation.
Advocate Vaibhav Jain represented the complainant during the court proceedings.
According to the complainant, the Ganj Police had earlier registered a case against Piyush Surana and sent him to judicial custody for a day.
However, no action was allegedly taken against Ramesh Soni despite his reposting of the same content.
The complaint alleged that police attempted to suppress the matter due to Soni’s influential position.
Subsequently, the complainant approached the court seeking directions for registration of a First Information Report under Section 79 of the Bharatiya Nyaya Sanhita and Section 67 of the Information Technology Act.
During arguments, Advocate Vaibhav Jain submitted that reposting and sharing obscene material also constituted an offence under Section 67 of the Information Technology Act.
Referring to the Supreme Court judgment in Lalita Kumari versus Government of Uttar Pradesh, he argued that registration of a First Information Report is mandatory whenever a cognisable offence is disclosed.
He further argued that examination of electronic evidence, including Uniform Resource Locator links, Internet Protocol logs, and related digital devices, was necessary in the matter and could only be carried out through a proper police investigation.
After examining the complaint, police report, and arguments presented by both sides, the magistrate referred the matter to Ganj Police Station and directed police to register a case against Bharatiya Janata Party City President Ramesh Soni.
